Contract partner and conclusion of contract
When booking and ordering vouchers, a contract is concluded with Sakura Spa GmbH, Poststrasse 14, 9000 St. Gallen, commercial register number CHE-338.570.885. Every order is binding. This also applies to prepayment orders. By placing an order, the customer concludes a valid purchase contract with Sakura Spa GmbH and undertakes to pay for the goods and accept them. Every voucher order is communicated to the customer by email. By clicking on the General Terms and Conditions field during the ordering process in the voucher webshop, the customer confirms that he has read and accepted the General Terms and Conditions. Only the German language is available for concluding the contract. In our voucher webshop the general terms and conditions are only available in german language.
Voucher purchase & voucher validity
When purchasing a voucher, the customer accepts the valid terms and conditions of the General Terms and Conditions. In the voucher webshop only the German language is available for concluding the contract.
All vouchers are valid for 3 years from the date of issue.
After this period has expired, Sakura Spa GmbH is no longer obliged to accept it. Lost vouchers will not be replaced. Vouchers cannot be returned for cash value. There is no right to fulfillment on the part of Sakura Spa GmbH if someone tries to redeem several vouchers with the same voucher number, even if the first redeemer is not the legal owner of the voucher.
Shipping costs
The shipping costs for vouchers sent by post are CHF 4.50. These shipping costs are not included in the voucher price, but are charged in addition to the voucher value. Postal delivery is only possible within Switzerland or to Liechtenstein.
Complaint / Exchange
It is not possible to take back vouchers and goods that have been correctly delivered by us. In the event of a complaint about incorrectly delivered goods, processing is only possible with a copy of the order in the online shop.
Delivery Terms
We make every effort to keep our online offers up to date at all times and to send the ordered vouchers, which are not printed online but should be sent by post, via A-Post immediately upon receipt of payment, normally within two working days, but without a delay to be able to assume liability. If you have not received the postal item after 5 days, please contact us immediately.
Refusal of acceptance
If the acceptance of the delivered goods is unjustifiably refused, we will invoice the incurred costs. However, the fulfillment of the purchase contract remains unaffected and legally valid. In the event of unjustified refusal of acceptance of the goods delivered by us, we will charge the costs incurred by us. Our right to fulfill the purchase contract remains unaffected by this.
Payment Information
Payment can be made either by credit card: The online transmission of credit card information is encrypted via the security certificate, guaranteeing a secure payment mode. Payment can also be made via prepayment invoice; the voucher will be sent by A-Post after receipt of payment or will only be released as an online voucher for redemption when payment has been made.
Cancellations of appointements
When booking an appointment, a contract is concluded with Sakura Spa GmbH. The customer accepts the valid terms and conditions of the General Terms and Conditions, he will receive a booking confirmation by email with the booked treatment, time, date and cancellation conditions.
If the customer cannot keep the appointment, the following cancellation conditions apply:
- up to 48 hours before the appointment: no cancellation costs
- up to 24 hours before the appointmentt: no cancellation costs
- less than 24 hours before the appointmtt: no cancellation costs
Personal data
We can only process orders properly if we are provided with correct, valid, complete information. We will not pass on your personal data to third parties. This does not apply to the transfer of information that is necessary for proper sales processing or a legal or judicial obligation to transfer your personal data to bodies authorized to receive information. We only collect the information that is suitable and necessary to process an order. In return, we can only process an order without delay if we have correct (particularly current) and complete information.
Changes of general terms and conditions
These general terms and conditions can be adjusted at any time and will then take effect immediately.
Applicable Law
These general terms and conditions and the use of the voucher webshop are subject to Swiss law. The place of jurisdiction for natural or legal persons is St. Gallen.
Severability clause
If any part of these Terms and Conditions is found to be unenforceable or invalid for any reason, this will not affect the validity of the remaining provisions.
